To the maximum extent permitted by law, Elite Health AU, this website, and all products and content on it accept no liability for any loss, injury or outcome arising from your use of them. You act on this information entirely at your own risk.


1. About these Terms

These Terms of Service (Terms) govern your access to and use of the website, platform, memberships and digital products offered by Elite Health AU (ABN 33 662 848 062) (we, us, our).

By creating an account, purchasing a product, or otherwise using the platform, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the platform.

These Terms include our Refund Policy (Section 11) and should be read together with our Privacy Policy.


2. Definitions

To keep things clear, the following terms have specific meanings throughout:

  • Platform: our website, member dashboard, and all related services at https://elitehealthau.com.
  • Protocol: a structured guidance plan, which is the core digital product available on the Platform.
  • Add ons: supplementary digital products including meal plans, training programs and supplement plans.
  • Membership or Subscription: an ongoing paid plan that renews automatically and grants credits and benefits.
  • Tier: a level of Membership (Beginner, Intermediate or Expert), each granting a set number of credits.
  • Credit: a unit used to unlock one Protocol. One credit unlocks one Protocol.
  • Account: your registered profile on the Platform, which records your owned Protocols, credit balance and Membership status.

3. Eligibility

To use the Platform you must:

  • Be at least 21 years of age.
  • Have the legal capacity to enter into a binding agreement.
  • Provide accurate registration details and keep them current.

The Platform is intended for adults aged 21 and over. It is not designed for, or directed at, anyone under 21. By using the Platform you confirm that you meet these requirements.


4. Your Account

When you register, you are responsible for:

  • Maintaining the confidentiality of your login details.
  • All activity that occurs under your Account.
  • Notifying us promptly at hello@elitehealthau.com if you suspect unauthorised access.

You may not share, sell or transfer your Account, your credits, or your owned Protocols to any other person. We may suspend or close an Account that breaches these Terms.


5. How the Membership Works

Our Membership model is built around credits and ongoing benefits. The mechanics below form part of these Terms.

Subscription tiers

We offer three Tiers. Each renews monthly and grants credits as follows:

  • Beginner: 1 credit per month.
  • Intermediate: 2 credits per month.
  • Expert: 3 credits per month.

Higher Tiers inherit the credit allowance of the Tiers below them. Credit allowances and Tier pricing are displayed at checkout and may change in line with Section 18.

Credits

  • One credit unlocks one Protocol.
  • Credits roll over permanently while your Membership remains active. They do not expire month to month.
  • A Protocol you unlock is yours to keep for life, regardless of whether you later cancel your Membership.

Loyalty benefits

As your Membership continues, loyalty discounts may apply across months 1, 2 and 3, after which your loyalty rate locks at the month 3 level. Loyalty discounts apply to eligible items such as meal plans, supplement guides and affiliate partner purchases. They do not apply to single Protocol purchases made outside a Membership.

Annual option

Where offered, an annual plan doubles the rate at which you earn credits compared with the equivalent monthly Tier.


6. Single Purchases

You may also buy a Protocol or an Add on as a single purchase without holding a Membership. Single purchases:

  • Are charged once at the price shown at checkout.
  • Grant you access to that product to keep for life.
  • Are not eligible for loyalty discounts.

7. Billing and Payments

Payment processing

All payments are processed securely by Stripe. We do not collect or store your full card details. Your use of Stripe is also subject to Stripe's own terms.

Automatic renewal

Memberships renew automatically at the end of each billing cycle (monthly or annually) using your saved payment method, until you cancel. By subscribing, you authorise us, through Stripe, to charge the applicable fee for each renewal.

Pricing and taxes

Prices are displayed in Australian dollars and, where applicable, include GST. We will tell you the price before you confirm any purchase.

Failed payments

If a renewal payment fails, we may retry the charge or pause your Membership benefits until payment succeeds. Your owned Protocols remain accessible.

Order references

Each order is assigned a reference in the format EHAU followed by a unique number, for your records and ours.


8. Upgrades and Downgrades

Upgrades

You may upgrade your Tier at any time. When you upgrade:

  • The prorated difference is charged immediately.
  • Your new access and credits are granted on the same day.

After one full month on a Tier, you may become eligible for ongoing upgrade pricing, which is reflected in your dashboard once unlocked. Where this applies, the eligible rate is permanent for as long as your Membership remains continuously active.

Downgrades

Downgrades take effect from your next billing cycle. Credits already earned remain in your balance subject to Section 10.


9. Cancellation

You may cancel your Membership at any time through your Account. When you cancel:

  • Your Membership will not renew at the end of the current cycle.
  • Protocols you already own remain yours to keep for life.
  • Your credit balance and loyalty status are handled under the Freeze and Restore mechanic in Section 10.

10. Freeze and Restore

Our model is designed to hold your value in place, not to delete it the moment you cancel.

When you cancel:

  • Your remaining credits and your locked pricing are frozen, not lost.
  • You have a window of 30 days from cancellation to restore your Membership and recover your frozen credits and locked pricing in full.
  • If you do not restore within that 30 day window, your frozen credits and loyalty status reset to zero.

Throughout all of this, any Protocol you have already unlocked stays yours permanently. The freeze applies to unused credits and loyalty standing, not to products you already own.


11. Refund Policy

This section forms part of these Terms.

Your rights under Australian Consumer Law

Our digital products and Memberships come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or removes those guarantees. Among other things, you are entitled to a remedy if a product is not of acceptable quality, does not match its description, or fails to meet a guarantee that cannot be excluded. Where a failure is major, you may be entitled to a refund.

Change of mind on digital products

Our Protocols and Add ons are digital products delivered to you immediately on purchase. Because access is granted instantly, we generally do not offer refunds for change of mind once a digital product has been delivered or a credit has been redeemed. This does not affect your rights under the Australian Consumer Law described above.

Credits and Memberships

  • Credits that have already been redeemed to unlock a Protocol are not refundable, because the product has been delivered.
  • Unused credits are handled under the Freeze and Restore mechanic in Section 10 rather than refunded.
  • If you cancel a Membership, you will retain access for the remainder of the current paid cycle, and the Membership will simply not renew. We do not provide partial refunds for an unused portion of a current cycle, except where required by law.

When we will provide a refund

We will provide a refund, replacement or other remedy where the law requires it, including where:

  • A product is faulty, not as described, or fails to meet a consumer guarantee.
  • You were charged in error, for example a duplicate or incorrect charge.

How to request a refund or remedy

Contact us at hello@elitehealthau.com with your order reference (EHAU followed by your order number) and a description of the issue. We aim to respond within 5 business days. Approved refunds are returned to your original payment method through Stripe.


12. Health Disclaimer

This section is important. Please read it carefully. It works together with the Important Disclaimer at the top of these Terms.

  • The Protocols, Add ons and all content on the Platform are provided for general educational and informational purposes only.
  • They are not medical advice and are not a substitute for advice, diagnosis or treatment from a qualified healthcare professional.
  • They are not intended to diagnose, treat, cure or prevent any condition.
  • We do not provide medical, clinical or therapeutic services, and nothing on the Platform creates a practitioner and patient relationship.
  • If you are ever unsure, consult a qualified health professional before starting, changing or stopping any health, nutrition, training or supplementation practice. This is especially important if you have an existing medical condition, are pregnant, or are taking medication.
  • Individual circumstances differ, and outcomes vary from person to person. We make no guarantee of any particular result.
  • You use the Platform and act on its content entirely at your own discretion and risk. To the maximum extent permitted by law, you assume full responsibility for any decision you make based on that content, and Elite Health AU, this website and its products accept no liability for the outcome.

If you experience a medical emergency, contact your local emergency service immediately.


13. Affiliate Partners

We may feature products or offers from third party affiliate partners. Where we do:

  • Those products are supplied by the relevant partner, not by us, and are subject to that partner's own terms, pricing and policies.
  • We are not responsible for partner products, claims or fulfilment, except to the extent the law makes us responsible.
  • We may receive a commission or benefit from partner purchases. This does not change the price you pay.

14. Intellectual Property and Licence

All content on the Platform, including Protocols, Add ons, text, design, branding and code, is owned by us or our licensors and is protected by law.

When you purchase or unlock a product, we grant you a personal, non transferable, non exclusive licence to access and use it for your own personal use. You may not:

  • Copy, redistribute, resell, publish or share the content.
  • Reproduce it for commercial purposes.
  • Remove or alter any branding or notices.

This licence ends if you seriously breach these Terms, although your right to use a product you have paid for will not be removed except as the law permits.


15. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose.
  • Attempt to gain unauthorised access to the Platform, other accounts, or our systems.
  • Interfere with, disrupt or overload the Platform.
  • Scrape, copy or harvest content or data without our written permission.
  • Misuse credits, pricing or promotions, including through fraud or manipulation.

16. Third Party Services

The Platform relies on trusted third party services, including Stripe for payments and other infrastructure and software providers. Your use of those services may be subject to their own terms and privacy practices. We are not responsible for third party services beyond our reasonable control.


17. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law or other applicable law.

Subject to that, and to the maximum extent permitted by law:

  • The Platform and its content are provided on an "as is" and "as available" basis.
  • Elite Health AU, this website, and all products and content on it accept no liability for any loss, injury, damage or outcome arising from your use of, or reliance on, the Platform or its content, including any health, fitness, nutrition or supplementation decisions you make.
  • We are not liable for any indirect, incidental or consequential loss.
  • Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant product or paying the cost of resupply.

18. Changes to the Platform and these Terms

We may update the Platform, our products, our pricing and these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, notify you. Changes do not apply retrospectively to purchases already completed. Your continued use of the Platform after changes take effect means you accept the updated Terms.


19. Suspension and Termination

We may suspend or close your Account if you breach these Terms, if required by law, or to protect the Platform and other users. Where we do so, you keep access to Protocols you have already paid for, except to the extent the law allows otherwise.


20. Governing Law

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
